Noida land scam: SC dismisses plea challenging Mahesh Sharma's acquittal

The Supreme Court on Monday dismissed a plea challenging acquittal of Union Tourism Minister Dr. Mahesh Sharma and former Uttar Pradesh chief secretary Neera Yadav in the 1997 Kailash Hospital land case in Noida.

The duo was acquitted by a CBI-designated court in 2010 in a case related to alleged irregularities in allotment of land to the private health facility in Noida.

The court had acquitted Yadav and Sharma, who was then the chairman-cum-managing director of the Kailash Hospital.

The petition against Yadav and others was filed by the Noida Entrepreneurs Association, alleging bungling in the allotment of land in different sectors and in commercial Sector 18 in Noida during her tenure as the head of Noida's Development Authority.

 

The hospital had got its land following a scheme of allotment of land for nursing homes and hospitals in Noida in 1991. Two categories, 1500 sq metres and 4000 sq metres, were offered under the scheme for nursing homes and hospitals, respectively.

The matter came to light after the Central Bureau of Investigation started investigations into the land allotment. A total of 4140 sq meters of land was allotted to Kailash Hospital by Neera Yadav, who also allegedly converted the land use of four residential plots into institutional category to favour the hospital.
