The anti-dumping duty under the aforesaid notification has been imposed for a period of five years unless revoked earlier, under subsection (1) and (5) of section 9A of the Customs Tariff Actread with rules 18 and 20 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles And For Determination of lnjury) Rules, 1995.
Sub section (1) of section 9A of the Customs Tariff Act provides that where anyarticle is exported by an exporter or producer from any country or territory to India at less than its normal value, then, upon the importation of such article into India, the Central Government may, by notification in the Official Gazette, impose an anti-dumping duty not exceeding the margin of dumping in relation to such article, and margin of dumping may vary from country to country which is determined by the DGAD.
Based on the investigations conducted and recommendation made by the Designated Authority, Directorate General of Anti-Dumping and Allied Duties, an anti-dumping duty at specified rates (as summarised in the table below) has been imposed, vide notification No. 61/2015-Customs (ADD)dated 11.12.2015, on imports of Cold Rolled Flat Products of Stainless Steel from the People's Republic of China, Republic of Korea, the European Union, South Africa, Chinese Taipei, Thailand and the United States of America.
