HC asks man to perform 'Kar Sewa' at gurdwara for eight weeks

The Delhi High Court has directed a man, who accidentally shot his lover and her husband and later shot himself in a bid to commit suicide, to perform 'Kar Sewa' for eight weeks at a gurdwara here.

Justice Vinod Goel also quashed the criminal proceedings and FIR lodged against the man, observing that all of them are still young and have their whole life ahead of them.

The court, however, ordered that the man shall perform 'Kar Sewa' at a gurdwara in Dwarka, once a week for three hours for a period of eight weeks, warning that default in showing up for the 'Kar Sewa' will lead to recall of its order to quash the FIR.

 

It also directed the man to deposit Rs 20,000 with the Prime Minister's Relief Fund.

The high court, which was hearing the man's plea seeking to quash the FIR, said: "All parties are still young and have their whole life ahead of them. It is clear that a cloud of passion and rage did not allow them to comprehend the consequences of their actions..."

Quashing the FIR, it said: "In the facts and circumstances of the case, since the matter has been amicably settled between the parties and having regard to the fact that the petitioner is still relatively young and his future career shall be jeopardized if the criminal proceedings are continued against him, no fruitful purpose would be served in further pursuing the said FIR."

As per the case, the boy and a girl fell in love in 2000-01 while studying at a college in Guwahati and in 2008-09, they performed a court marriage which was only known to the family members of the husband.

The woman continued to live with her parents as she did not tell about the marriage, but over time, the relations between her and her husband began to deteriorate and they grew distant with each other.

In 2016, the woman came in contact with a man residing here and they fell in love with each other. The same year, she came here for training for a period of three months and when her husband came to Delhi for business purposes as well as to meet her, he became aware of the extra-marital affair.

The husband confronted his wife and the other man saying they couldn't get married as she was already married to him and he would take her back to Guwahati after she completes her training.

The other man got aggressive and took out his father's licensed pistol and tried to shoot himself. At this point, the woman tried to snatch the weapon from him, leading to it getting discharged and injuring her and her husband. The man then shot himself in a bid to commit suicide.

After the incident all three were admitted to the All India Institute of Medical Sciences for treatment and police registered an FIR against the man for attempt to murder and under various section of the Arms Act.

Later, the parties have subsequently entered into a compromise and decided to amicably settle all their disputes with the help and intervention of family members.
