'MH17 investigation team considering independent court'

Malaysian authorities said on Tuesday that partners in the Joint Investigation Team (JIT) on the MH17 incident are considering setting up an independent international court for an effective prosecution mechanism for those responsible.

In a statement following the release of the Dutch Safety Board (DSB) final report, Malaysian Transport Minister Liow Tiong Lai said as the international tribunal under the UN Security Council may have been vetoed, Malaysia, the Netherlands, Belgium, Ukraine and Australia are working on adopting a treaty to establish an independent international court.

The final report "clearly points to a 9N314M-model warhead carried on the 9M38-series of missiles, as installed on the Buk surface-to-air missile system as being the cause of the crash of MH17," Xinhua quoted him as saying.

 

"As part of the JIT, Malaysia remains single-minded in our pursuit of decisive action that will lead to prosecution of the trigger-happy criminals," he added.

Liow called on changes to be implemented in global commercial aviation operations.

"There must be mandatory timely reporting of relevant information on flight risks to the International Civil Aviation Organization (ICAO) by member states and ICAO must establish global protocol to disseminate this information to member states and airlines," he said.

Malaysian Prime Minister Najib Razak also said in a statement that he spoke to Dutch Prime Minister Mark Rutte, Australian Prime Minister Malcolm Turnbull and the Dutch Safety Board earlier on Tuesday before the release of the final report.

He expressed the commitment to bringing the perpetrators to justice, saying "the on-going criminal investigation, which was being led by the Dutch with our full support, must provide definitive answers and allow us to pursue the strongest action possible against those responsible."

Malaysia Airlines said in a statement that it will continue to cooperate with the authorities on all matters pertaining to the loss of MH17 and its support to the families will remain until all issues are completed.
