SC notice to Gujarat on birds right to fly

The Supreme Court on Friday issued notice to Gujarat on a PIL challenging a 2011 Gujarat High Court order effectively banning the caging of birds as it held that flying was their fundamental right.

An apex court bench of Chief Justice H.L. Dattu, Justice Shiva Kirti Singh and Justice Amitava Roy issued the notice after senior counsel Salman Khurshid, appearing for the PET Lovers Association, urged the court to set aside the judgment.

Describing as erroneous the high court order that birds could not be caged as they had a fundamental right to fly, Khurshid said there were laws that protected the domesticated birds.
