The Delhi High Court judgment that the office of the Chief Justice of India (CJI) is a public authority that comes under the ambit of the Right To Information (RTI) Act is welcome. At last, the ambiguities arising out of the RTI Act versus the Supreme Court have been cleared through this verdict.
Surely, this is a right step towards bringing in transparency in the judiciary.
There is little doubt the higher judiciary is a public authority since judges deliver on public pleas on the failures of the legislature or of the executive. And, in the process of executing orders on public hearings, the judges are becoming more of public servants than arbitrators.
Also, there should be more proper institutional mechanisms needed to ensure transparency in the judiciary.
