Two brothers, who attempted to kill their sister's mother-in-law, have been sentenced to five years in jail by a Delhi court.
Additional Sessions Judge Sanjay Sharma handed down the rigorous imprisonment to Delhi residents Gul Mohamad (28) and Ali Mohamad (26) for firing at 45-year-old Samina, mother-in-law of their sister.
"Keeping in view the fact that both the convicts are quite young and that they have their families and have no criminal antecedents, Gul Mohd and Ali Mohd are sentenced to five years rigorous imprisonment," the judge said.
While sentencing the convicts, the court said it has to consider the societal interest and the impact of the crime on the society.
"Both the convicts are quite young and have family responsibilities. Sentencing is a delicate exercise. The court is conscious of the fact that sentencing a person to punishment may have adverse impact on him," it said.
The court also imposed a fine of Rs 5,000 on each of them.
While holding the brothers guilty of the offence under sections 307 (attempt to murder) read with 34 (common intention) of the IPC, the court relied on the testimony of the victim, who deposed that the relationship between her family and daughter-in-law was bitter and that's why her brothers, Gul and Ali, had tried to kill her.
"Keeping in view the bitter relation of victim and the accused persons, the court is under duty to scrutinise the evidence minutely...The deposition of Samina and her injuries are corroborated by medical and forensic evidence," the court said.
According to the prosecution, on December 13, 2009, when the woman was walking towards home near Yamuna Vihar here, Gul and Ali, who were on a bike, fired bullets at her and fled from the spot. The woman was later rushed to GTB hospital in PCR van.
Both the brothers were arrested in 2010 and were charged for attempt to murder. During the trial they pleaded innocence and claimed that they were falsely implicated as a dispute between their sister and the complainant Samina was pending in Crime Against Women Cell.
