: Madras High Court today issued notice to three persons, including two advocates, who obstructed sealing of an illegal building in George Town area.
The First Bench, comprising Chief Justice Sanjay Kishan Kaul and Justice R Mahadevan gave the direction when a PIL with regard to illegal and unauthorized constructions in the area came up before it.
The bench gave the direction aftert police identified the three persons and submitted a report with photos to the court, as directed by it earlier.
"In so far as persons who sought to obstruct the process, it is pointed out that three of the persons have been identified and surprisingly two of them are advocates, while one is stated to be a political person."
The bench then directed that notices be issued to them and for all three to be present in court on Sep 4 to explain their conduct in obstructing sealing and reportedly threatening officers.
It then posted the matter to Sept 4.
The matter relates to hearing of a PIL on unauthorized constructions in George Town and steps taken by authorities. When the matter was being heard,petitioner 'Traffic' Ramaswamy had mentioned that officers were afraid of taking action as they were being threatened from some persons at the time of inspection of the buildings.
Taking note of such one incident explained by the officer who was present in court, the bench had directed the house owners of the building to be present in Court and during a hearing had directed that any photographs or video taken at the time of the incident, be produced in court
In the earlier hearing some photographs were produced by the authorities to the bench, which directed police to identify the persons obstructing the sealing activity.
As per the direction, police submitted a report to the bench, which directed the Deputy Commissioner of Police to effect service of notices to the persons identified and to remain present in person on Sept 4.
