Alleged Woman bootlegger let off by court

Metropolitan Magistrate Naresh Kumar Laka acquitted Raghubir Nagar resident Yashoda Devi, allegedly caught with illegal liquor can in 2004, saying that the prosecution has failed to prove the case against her.

While letting off Yashoda, the court said the upkeep and safety of the case property is also of utmost importance till the offence is proved in the court of law.

"From the manner of sealing and production of case property, it is not proved whether the case property, produced in court is the same one which was recovered from the possession of accused, as alleged.

"As the lid of the cane was easily removable without disturbing the seal, it left all the option open to change or alter the case property easily. On this account, the accused is entitled to the benefit of doubt," the court said.
