The 26-year-old was arrested on suspicion of driving under the influence after she side-swiped a police car, reported Daily Mail online.
"Amanda Bynes refused to take a breathalyzer test, or blood test, which is required under California law when someone is arrested for a DUI," California law enforcement officials said.
Bynes was arrested on April 6, just three days after celebrating her birthday. If convicted of the DUI charge, she faces up to 48 hours in jail and losing her drivers license for one year.
However, her father has argued that she does not drink and a DUI would not have been possible.
"She did not have a single drink that night. My daughter does not drink," said Bynes.
