Durai told the the special CBI court of Pravas Kumar Singh that he had received a order from the Centre in 1997 to enquiry into the 'conduct of the CBI officers', who sought army help to execute the warrant of arrest against Prasad citing a court order.
But it was found in the enquiry report, submitted on August 18, 1997, that CBI had not given any petition before the high court, Durai told the court.
The RJD leader, who resigned as chief minister following the multi-crore rupees fodder scam, had surrendered before a court on July 30, 1997.
Durai, who was the 22nd witness in a fodder scam case, had also been examined as a defence witness in a disproportionate assets case against RJD MP in Patna in 2004.
The court has fixed July 19 for deposition of one of the then army officers in connection with the matter.
