After a 10-year-long legal battle, a local court today rejected the appeal of the main accused in sensational Ashiyana gangrape case and held that he was a major at the time of committing the crime.
The application of main accused Gaurav Shukla was rejected by the court of additional district judge Rajendra Singh, who termed him as a major at the time when the 13-year-old girl was gangraped by six persons in Ashiyana locality here.
The court was of the opinion that March 14, 1987 was the original date of birth of Gaurav, who is nephew of a former SP MLA, the victim's counsel Jalaj Gupta said.

The court fixed March 27 as the next date for framing of charges against Gaurav.
The juvenile justice board had on March 21, 2014 also termed the main accused as major against which he appealed in the sessions court saying that he was minor.
The sensational incident occured on May 2, 2005 when the girl was kidnapped, gangraped and brutally tortured.
