Additional Chief Metropolitan Magistrate (ACMM) Sameer Bajpai dismissed the bail plea of Ahmedabad resident Kantibhai Gopaldas Patel, saying he was "involved in a similar offence" earlier.

Patel was deported back to India after being caught by US Immigration for entering USA illegally.

"Investigative officer has also reported about the previous involvement of the accused (Patel) in his report. It is seen that Patel has misused the liberty given to him by the court in previous case.

"Accused has repeated the offence which he had committed earlier. I am of the opinion that Patel deserves no leniency," ACMM said while dismissing Patel's bail plea.

The prosecution said that Patel was arrested on April 27, from IGI airport after his deportation from USA.

The police took Patel into custody after knowing that his passport has no departure or arrival stamp of any country.

The police told the court that Patel the accused is also facing trial in another similar case lodged in 2008, in which he was granted bail.
