Bench orders notice to Secys of school edn, TRB, DSE

: Madras High Court bench today ordered notice to Secretaries of School education, Teachers Recruitment Board and Director of School education on a petition challenging TRB's appointment process to the post of BT Assistant in Tamil, based on a Government Order,giving five per cent relaxation in pass marks in Teacher Eligibility Test.

Justice T Raja ordered issue of notice on a petition filed by one S Jeevarathinam of Usilampatti, who submitted that the bench had already held the February 6 2014 G.O by by TRB on relaxing the marks was illegal and erroneous.

The G.O. Provided five per cent relaxation and thereby TET pass mark was lowered from 90 marks to 82 to candidates of Scheduled Caste, Scheduled Tribe, Backward Class, BC (Muslim), Most Backward Class, Denotified Community and persons with disability.
 

When candidates had challenged the GO,the bench had heard it and held the GO as illegal and quashed the same, he said.

Accordingly, TRB ought not to have appointed persons who scored less than 90 marks in the TET to the posts. But the TRB issued selections lists on Oct 14 to the department of BC and MBC, Chennai and Coimbatore Corporations to fill up vacancies. As a result, the petitioner said he had missed his opportunity to get appointed, though he scored 91 marks.

Hence he prayed for a direction from the court to the appointing authority to give him government job and further to restrain the authority from selecting and appointing candidates based on the GO.
