Bench quashes Collector's order on patta to 216 BPL persons

Madras High Court bench today quashed the order of Madurai District Collector, cancelling the patta given to 216 Below Poverty Line persons and directed revenue officials to survey the land and allot the plots, fixing the borders, as well as Patta for the site.

Allowing a petition filed by Abbas of Navinipatti in melur taluk, Justice K B K Vasuki said revenue officials should provide them the plots, with areas marked and give them six months time to construct their houses.

The Petitioner submitted he was alloted a plot by an order in 2001. He then submitted a petition to officials to survey the land and fix borders for his plot so that he could build a house. But the Tahsildhar did not take any action, he alleged.
 

Abbas then filed a petition, seeking a direction to them to do so. The Court disposed the case, asking him to approach the officials and get the remedy.

However officials said they had cancelled the patta as the petitioner and others did not build the house.

The petitioner sought to know how he could take up construction when he was not aware which was his plot. The officials had assigned the land without marking the area, he said, adding he was not responsible for their blunder.

Abbas contended that it was the duty of officials to fix the borders, instead of which they had cancelled the patta and sought cancellation of the revenue officers order and he be be issued the plot and patta.
