The Bihar government is contemplating to file an appeal in the Supreme Court challenging the Patna High Court order that contractual teachers were entitled to salary at par with the regular ones,a top official said today.

"We are examining the High Court order and planning to take legal recourse. Though we have not arrived at a decision yet, an appeal against the High Court order is under consideration", Principal Secretary, Education, R K Mahajan told PTI.

Mahajan said "we had opposed the demand for giving regular pay scale to contractual teachers even before the High Court. Our contention was that the regular scale was a dying cadre. Moreover, contract teachers were appointed under certain terms and conditions which would be nullified if they were entitled to regular pay scale".
 

"We had also submitted before the High Court that over the years, there has been a substantial hike in the salary given to contractual teachers. The judgement did not seem to take our submissions into account. We are therefore thinking in terms of seeking the legal remedy that is available", the Principal Secretary added.

The Patna High Court had passed the aforesaid order on October 31 holding that the principle of "equal pay for equal work" was applicable to contractual teachers.
