Can't charge extra for giving alternate plot: NCDRC tells HUDA

The National Consumer Disputes Redressal Commission's (NCDRC) order came on an appeal by the HUDA against Haryana State Consumer Commission's order which had quashed the state's urban planning body's demand of extra payment to hand over an alternate plot.

The HUDA had demanded Rs 66,725 from Haryana resident Shyam Sunder for handing over an alternate plot to him.

Dismissing the HUDA's plea, the NCDRC said, "It stands proved that the petitioner (HUDA) was unable to give the first plot to the complainant (Shyam). It is difficult to hold that the inability of the petitioner would cost the complainant a sum of Rs 66,725.

 

"It is the bounden duty of the petitioner to give the alternative plot. There is no inkling that the alternative plot measured more than the previous plot. The complainant is suffering from this problem for the last 22 years. He had applied for a plot on May 10, 1990," said bench presided by Justice J M Malik. (MORE)
