CBI had earlier argued that there was no stay on the CBI court from taking cognizance of the chargesheet.
The high court is hearing two public interest litigations seeking court supervision in the Adarsh probe.
Both Adarsh Society and the Maharashtra government have filed applications in the high court opposing CBI probe in the matter as neither the court nor the state government had consented to investigation by the central agency.
The special CBI court will now hear the case next month.
The CBI had filed 10,000 pages chargesheet on July 4 in the matter against 13 people, including former Maharashtra Chief Minister Ashok Chavan.
The central agency had initiated probe in the matter in November 2010, after direction from the Ministry of Defence.
