The Centre has been continuously persuading states to adopt the Clinical Establishments (Registration and Regulation) Act, 2010, or to consider bringing a state-specific legislation if the adoption is not suitable, the government today said.
Union Minister of State for Health and Family Welfare Anupriya Patel in a written reply to a question in the Rajya Sabha, also said, the Act has been adopted by 10 states and all the Union Territories (UTs), "except Delhi".
"Health being a State subject, the registration and regulation of clinical establishments falls within their remit. States are being continuously persuaded to adopt the Clinical Establishments Act, 2010, or to consider bringing a state-specific legislation if adoption of the Act is not found suitable," she said.
The minister said the Act has been adopted by Sikkim, Mizoram, Arunachal Pradesh, Himachal Pradesh, Uttar Pradesh, Bihar, Jharkhand, Rajasthan, Uttarakhand and Assam, and all UTs, except Delhi.
In a reply to another question on whether the government has asked all hospitals and suggested all states and UTs to strictly implement the Act, she said, "The government is persuading the states who have adopted the said Act for its strict implementation."
The Centre had last month written to all states and UTs to implement the Act in the wake of the family of a dengue patient being allegedly overcharged by a private hospital.
The Act was enacted by the Centre to provide for registration and regulation of all clinical establishments in the country with a view to prescribe the minimum standards of facilities and services provided by them.
The Act is applicable to all types (both therapeutic and diagnostic types) of clinical establishments in the public and private sectors.
