Civic officials not acting swiftly in removing encroachments

: Observing that civic authorities are not acting swiftly on removing encroachments and acting unauthorized constructions, the Madras High Court has said the violations have to be curbed with an iron hand.

The court noted that there are lot of violations in chennai with regard to construction and land encroachments, which have got to be curbed with an iron hand.

There is no reason why authorities are ineffective in taking steps and even if steps are taken, it moves at a snail's pace, the court said in its recent order.

It refused to interfere with the demolition notice and lock and seal orders issued by Chennai Corporation, including to one building in Alandur area and said it felt authorities must take dynamic action to decimate the violated buildings without standing on any technicalities.
 

The bench said wherever there are encroachments on roads, the original road width has got to be restored. F there is no building plan, or there are plan deviations, they must be removed by the violator. If not, authorities are entitled to remove them and recover demolition costs from the violator.

Declining to entertain the plea of a violator of the building at Alandur that the demolition notice was not issued to the actual building owners and so needs to be quashed, it directed the officials to issue a fresh notice to the owner within 15 days.

The bench made it clear that if the unauthorized portion was not removed by the owners, the authorities are entitled to demolish and recover the cost from the real owners of the property.
