The Delhi High Court today asked Delhi government to take a decision regarding inter-state transfer category in nursery admissions here and to come out with a fresh schedule for draw of lots by tomorrow.
Justice Manmohan passed the order after Delhi government submitted there has been massive misuse of the inter-state transfer category and if the issue is left to it a decision will be taken immediately.
The counsel for the government assured the court that it will take a decision on scrapping the inter-state transfer category by this evening and will come out with a fresh schedule for draw of lots for admission to nursery classes by tomorrow.
The new draw of lots schedule would impact the ongoing nursery admission process.
Under the existing system, out of total 100 points, 70 are given if the child lives in the neighbourhood of the school, additional 20 are given if a sibling is studying there, five points more if either parent is an alumni and five points if it is an inter-state transfer case.
Only those having 75 out of 100 points are considered for draw of lots while those having 90 points are automatically admitted.
The court passed the order while disposing of the petition of one Sudhanshu Jain who had challenged the system of giving five points to children whose parents have been transferred to the national capital from another state.
The court said that Jain's petition, filed through advocates Prashant Mehta and Himanshu Kapoor, be treated as a representation before government which has to disposed of within a week.
During the proceedings, Delhi government told the court that on analysis of admission data of over 50 leading schools of Delhi, it was found that approximately 46 per cent of open seats were claimed under the inter-state transfer category and 2.4 per cent of the applications are from NCR zone.
The government also submitted that on scrutiny of the 1520 applications in which inter-state transfer was claimed, over 800 were found to be non-genuine.
