A Delhi consumer forum has asked a private investment management company here to pay a compensation of Rs one lakh and return Rs 3.1 lakh to a man for selling him a car with wrong documents in an online auction.
New Delhi Consumer Disputes Redressal Forum, presided by C K Chaturvedi, asked Delhi-based Ata Capital to pay Rs 4.1 lakh to Ambala resident Sachin Lohan, while holding the company guilty of deficiency in service.
Lohan had said that he purchased a car from the firm in an online auction but later he got to know that it was sold to him with wrong documents.
"Opposite Party-1 (Ata Capital) has no answer to this mistake but wants to resolve the matter. Ata Capital failed to complete its obligation and committed serious deficiency because of which complainant could not enjoy car.
"We direct Ata Capital to return this money of Rs 3.10 lakh...And we also award Rs one lakh towards compensation for harassment and litigation expenses," the forum, also comprising its member Sita Ram Chaudhary, said.
Lohan had told the forum that he purchased the car from the firm through a website and paid entire amount of Rs 3.10 lakh.
The firm had given documents of one Narendra Kumar to be transferred in the name of Lohan by concerned RTO office. However, the RTO informed him that the vehicle was in the name of Suresh Kumar, he said.
Alleging that the firm had given wrong documents of the vehicle registration due to which he could not get the car registered in his name so far, Lohan filed the complaint before the forum.
