The Madras High Court bench here today directed the Chief Controller of Explosives to consider the representation of a petitioner seeking a ban on holding fireworks display using Chinese crackers.
Justices R Sudhakar and V M Velumani stated this while disposing a PIL filed by one K K C Balaganesan who also sought a direction to seize banned Chinese crackers from those conducting fireworks display during matches.
He sought a direction to CBI to register cases against those holding fireworks display under Explosives Act for illegally bringing crackers and displaying them.
The petitioner sought a direction to take action against Marshal Sports Private Ltd and its Managing Director for organising pro-Kabaddi league matches, allegedly displaying 'harmful' Chinese crackers during start of matches in major cities.
The petitioner submitted that the Centre had banned use of Chinese crackers and their import. Several circulars had also been issued to seize crackers imported from that country and destroy them as the chemicals used were harmful and noise pollution caused was high.
But despite strict government orders, the company, which organised the pro Kabaddi league in all major cities from July l8 to August 23, had held fireworks display with Chinese crackers to encourage viewers and players, the petitioner said.
He submitted that police had registered several cases and seized crackers imported from China illegally from 2011-15. Display of Chinese fireworks despite a ban only showed that the ban had not been effectively implemented, he said.
The petitioner said he had sent a representation to officials of the Ministries of Home, Industries and Commerce, Sports and Games on this matter but no action had been taken.
