Consumer forum asks SBBJ to pay Rs38K for dishonouring cheque

The New Delhi District Consumer Disputes Redressal Forum's order came on a plea by Moti Nagar resident Devender Sahni, alleging dishonour of his cheque by the SBBJ.

Observing that the bank "has failed to defend its position," the forum presided by C K Chaturvedi directed it to credit back an amount equal to the cheque which the bank had dishonoured and to pay him compensation of Rs 25,000.

"We direct OP (State Bank of Bikaner and Jaipur) to credit back Rs 13,575 back into account of complainant (Devender Sahni) with interest of 9 per cent, if not already done. We also award a compensation of Rs 25,000 for harassment to him, inclusive of litigation charges," the bench said.

 

Sahni in his complaint had said he had issued a cheque for Rs 13,500 in favour of Vivek Summit School, where his grandson studied, for payment of his school fees.

The State Bank of Bikaner and Jaipur had told Sahni that the cheque was cleared, but the school informed him that they had not received the amount and demanded that he deposit the fees in cash, he had also said.

When Sahni approached the bank he found that his cheque was dishonoured allegedly for insufficient funds in his account and that the bank had also levied a penalty of Rs 75 for the same.
