Consumer Forum directs builder to compensate co-op CHS

Thane District Consumer Redressal Forum (DCRF) has directed a builder here to pay a compensation of Rs 25,000 to a housing society in a 2012 property case.

President of the Forum Sneha S Mhatre and members Madhuri Vishwarupe and ND Kadam ordered Chairman of Lok Housing to pay a compensation of Rs 25,000 to Gunjan Lokpuram Co-operative Housing Society (CHS) for failing to transfer the conveyance deed on its name.

The amount is to be paid within a period of three months from the date of order, the order said.

In its complaint the society stated that as many as 22 customers purchased row houses from the builder Lok Housing and the Society was formed in 1995 but it did not transfer the conveyance deed and other relevant documents on the name of the Society.
 

Despite repeated reminders, the builder did not pay any heed to society's request. The complainant also demanded a compensation of Rs 10 lakh from the builder.

The court in its judgement delivered yesterday, decided the matter ex-parte against the builder as the respondent did not appear nor made any submission in the case.

The Forum relied on the documents submitted by the complainant like the agreements, deed of confirmation, declaration and found the builder in violation of Section 11 of Maharashtra Ownership Flats (Regulation of the Promotion, Construction, Sale, Management and Transfer) [MPFA] Act.
