Contempt case against Salman:complainant seeks lifting of stay

A social worker, who has filed a complaint against actor Salman Khan before a magistrate for posting information about the court cases in which he (the actor) is involved on a website, today urged the Bombay High Court to vacate its stay on the proceedings against the actor.

Hemant Patil, the complainant, alleges Khan committed contempt of the court by posting the information.

Khan had approached the High Court against the magistrate's summons on Patil's complaint.

Salman is facing trial in the 2002 hit-and-run case in which he is charged with killing a person and injuring four others by ramming his car into a roadside bakery.
 

His petition before the HC says that he created the website only to ensure that there was no incorrect reporting of the case by the media and the portal only gives facts, nothing else, which does not amount to contempt.

His lawyer also pleaded that as the main case (hit and run) was now before the sessions court, the magistrate's court could not hear a related complaint of contempt.

Justice M L Tahilyani had on August 26 stayed proceedings before the magistrate's court.

Patil's affidavit in reply, filed today, said posting information about pending cases was unlawful and the magistrate was right in issuing the summons.

The next hearing in the High Court would be on October 26.
