Contempt notice against Union Home Secy

The Allahabad High Court today issued contempt notice against Union Home Secretary Rajiv Mehrishi on a petition filed by suspended IPS officer Amitabh Thakur.

Justice Anil Kumar of Lucknow bench gave the order after hearing the petitioner.

Thakur had challenged his suspension order dated July 13, 2015 before the High Court on the basis of 150 days having lapsed without its review, while Rule 3(8) of All India Services Discipline and Appeal Rules warrant its review within 90 days.

The writ court had directed him to present his appeal before the Union Home Secretary, directing him to decide it within three weeks.
 

The petitioner alleged that he had presented his appeal to Union Home Secretary on December 18, 2015 and then filed a contempt petition after passage of the mandated period of three weeks.

"Issue notice to opposite party (Rajiv Mehrishi) to show cause through counsel why he be not punished for violating the order passed by writ court. List it in the month of April, 2016," the court ordered.
