The Nrimata Bhairab Seva Samity today filed the case before the Cachar Chief Judicial Magistrate under IPC's Section 119, 153(A), 203, 295(A) and 505.

The Samity's president, Nanigopal Dey, and secretary Benubhushan Roy in the petition alleged that Nath had visited the temple on May 13 last with her first husband Dr Rakesh Singh and performed a puja there, though she had converted to Islam on April 13 to marry her second husband Jacky Zakir.

The legislator had during her visit to the temple denied that she had married for the second time by converting to Islam, claiming it was a canard spread by her detractors within the party.

The petitioners pointed out that she, however, later confirmed that she had married Zakir.

The MLA's statements have not only hurt the religious sentiments of the people of her constituency but she has also lied and misled them, the petitioners claimed.

The first witness of the case would be the MLA's first husband who has also filed a case against her and her second husband accusing her of bigamy, illicit relation and theft.

She had also filed a case against her first husband alleging that he used to beat her and had threatened her with dire consequences on several occasions.

Nath had allegedly eloped with Jacky Zakir last month and resurfaced in Guwahati last weekend following which she publicly admitted to marrying a second time without divorcing her husband.

Nath was first elected to the Assembly in 2006 on a BJP ticket from Borkhola and later defected to the Congress, retaining the seat for the second consecutive term in 2011.
