A man has been acquitted by a Delhi court on the charges of possessing over 22 Kgs of banned drugs, saying there was a possibility of his "false implication" in the case by his wife and in-laws due to some monetary dispute between them.
Special NDPS Judge M K Nagpal acquitted Delhi resident Samsuddin for the offences under the Narcotics Drugs and Psychotropic Substances (NDPS) Act pertaining to possession and transportation of a commercial quantity of banned drugs.
"...The defence evidence of the accused led on record.... clearly makes out a possibility of false implication of the accused in this case at the instance of his wife and other members of her parental family for some monetary dispute between them as an application/complaint was filed by the accused against them on April 8, 2011 and just after about a week thereof, i.E. On April 17, 2011, the accused has been shown to have been apprehended with Ganja," Special NDPS Judge M K Nagpal said.
The court also said there were material contradictions in statements of prosecution witnesses.
The court said Samsuddin cannot be convicted on the basis of the "shaky evidence" of the prosecution and acquitted him by giving benefit of doubt.
According to the prosecution, Samsuddin was arrested on April 17, 2011 from Okhla bus stand here when he was found possessing and transporting 22.5 KG Ganja on a scooter which was in contravention of the provisions of the NDPS Act.
During the trial, Samsuddin claimed to be innocent and said he was falsely implicated in the case at the instance of his wife, mother-in-law and brother-in-law, in collusion with the local police.
He said he had made a complaint on April 8, 2011, against his wife and in-laws as they were not returning Rs three lakh which they had taken from him and after a week they got him falsely implicated in the case.
