Additional Sessions Judge Sanjay Garg let off East Delhi resident Sumit Raj saying the girl appeared to be a major from her physical appearance.
"The observation of the court while examining the girl is very important where it has observed that she appears to be major more than 18 years of age from her physical appearance," the judge said.
According to the prosecution, the girl's father had lodged a complaint in December 2010 that his 14-year-old daughter had gone to tuition and had not returned home. He suspected Raj, his neighbour, of kidnapping her as he too was missing from his house.
The police had recovered the couple four days later and were taken to hospital.
Raj, in his statement to the court, said the girl had run away from her house due to continuous rebukes by her parents and had called him to the railway station to take her away, otherwise, she said, she would commit suicide.

He added he had persuaded the girl to go back home and then they both had gone to the police station where he was arrested and was falsely implicated in the case.
The girl too told the same to the court. The couple also said they had got married last year and are living happily and also have a son, who is two months old now.
The court said it was clear that the girl, now 20, had left her house and reached Mandawali railway station and then she had called Raj there.
"Even after marriage, they both stayed at the railway station. The necessary ingredients of kidnapping, that is, taking or enticing are not there as per the facts of this case," it said.
