Court asks for production of Cuttack murder accused

A local court today directed police to first produce before it two murder accused in response to its plea for subjecting them to polygraph test.

The request for polygraph test was sought by the Cuttack Commissionerate police for the purpose of probe.

The Sadar SDJM court directed police to produce the arrested brothers Sushil Kumar Dhalasamanta and Sushant tomorrow.

The two were now on police remand after being arrested on January 29 in connection with the case of abduction and murder of two youths, who had gone missing since December 2012.

The missing youths Deepak Mallick alias Dipu and Om Swain alias Om were close associates of the Dhalsamant brother duo and working in their gang, according to the prosecution.
 

Chauliaganj police Inspector Ajay Kumar Das had sought the SDJM court's permission to conduct polygraph test on the arrested duo.

Objecting to the police prayer, advocate of the brothers Soura Chandra Mohapatra argued that the Supreme Court in the case of 'Smt Selvi V/s the government of Karnataka in 2010' had laid down the law regarding the procedure for polygraph test in which the consent of the accused must be taken before allowing the prayer of the prosecution.

He also contended that there is no provision in CrPC allowing the prosecution to conduct polygraph test on the accused.

Meanwhile, a rights activist moved the high court in a PIL seeking a CBI enquiry into the whole episode of arrest of the Dhalasamanta brothers and their political link.

Claiming that a huge cache of arms and ammunition, which are used by defence forces, were seized from the arrested brothers, the petitioner contended a CBI inquiry would reveal the involvement of influential persons.
