Court asks man to pay Rs 3,500 maintenance to estranged wife

Metropolitan magistrate Shelly Arora directed the south Delhi resident not to contact his wife or her relatives without the court's order after observing that he was harassing her.

"She (wife), however, now has been residing separately with her parents. Respondent (husband) is accordingly forbidden to communicate with the applicant (wife) or her dependents or her relatives in any form including personal, oral or written or electronic or telephonic contact without specific order by the competent court concerned," the court said.

The court's order came on a plea filed by the woman who alleged that she was thrown out of her house by her husband and in-laws in August, 2010 after she had refused to comply with their dowry demands.

 

In her complaint, the woman said her husband and his family members always "harassed, tortured, humiliated and ill-treated" her as she did not fulfil their dowry demand of a car and Rs one lakh in cash.

She alleged that her husband had beaten her several times, often in an inebriated state.

The court passed an ex-parte order as the man did not appear before it despite being served with a notice.

While deciding the maintenance, the court assessed the man's monthly earning to be Rs 10,000 and asked him to pay Rs 1,500 per month towards rent and Rs 2,000 as monthly monetary payment to his wife.

"Respondent (husband) being morally or legally responsible for the care of the applicant (wife), is directed to pay total amount of Rs 3,500 per month...," the court said.
