Observing that the woman died due to the negligence of the bus driver, Presiding Officer of Motor Accident Claims Tribunal Vineeta Goyal held the driver as well as the Delhi Transport Corporation (DTC) guilty as "joint tort feasors" and "jointly and severally liable" to pay the compensation.
"In the present case, from oral coupled with documentary evidence, it is prima facie established that the victim had sustained fatal injuries on account of negligent driving of the driver of offending vehicle.
"Accordingly, a compensation of Rs 18,00,920 is awarded to petitioners,(husband and children of the deceased)," the Tribunal said.
United India Insurance Company Ltd, with which the DTC bus was insured, was held liable by the Tribunal to pay the compensation to the family of the deceased Kalawati. (more) PTI HMP SKV
