Court denies bail to gangrape-cum-murder case accused

Additional Sessions Judge (ASJ) Kamini Lau dismissed the plea of Delhi resident Hitesh who is accused of gang-raping a girl with the help of his associate Monu in a moving car on March 19, 2010 morning in Bawana area in North West Delhi after kidnapping her.

"Keeping in view the nature of allegations involved, seriousness of the offence and the fact that when on bail, the accused (Hitesh) got himself involved in other criminal cases, I am not inclined to grant any indulgence to the accused," the court said.

The judge also observed that co-accused Monu is absconding till now and if granted bail, Hitesh might also abscond as he has been charged for the offence of murder.

 

"The allegations against the accused also had prima facie find support from the medical, forensic and circumstantial evidence which have now emerged. The possibility of Hitesh absconding, making it difficult to secure his presence during trial, too cannot be ruled out," the court said.

It had earlier expressed anguish over the "casual" manner of city police in chargesheeting Hitesh for a milder offence of attempt to rape.

The court was upset that despite medical records suggesting that the 15-year-old girl was raped, the police chargesheeted Hitesh only for the offence of attempt to rape and causing grievous hurt to her. MORE
