Court dismisses mother's plea against son, daughter-in-law

A woman, who had sought maintenance and compensation for her sufferings from her son and daughter-in-law, has failed to get any relief in a Delhi court which dismissed her plea saying there was no domestic relationship between them.

The court decided the issue against the woman saying she had admitted that prior to separation of family members, including her five sons, they were living together peacefully and no incident of domestic violence during that time has been alleged by her.

"...From the material on record it is quite apparent that the dispute is civil in nature pertaining to some property, pursuant to which some quarrel between parties have occurred.
 

"From the evidence led, the complainant (woman) has failed to show the existence of a 'domestic relationship' since the dispute arose. It is the complainant's own case that prior to separation of family members, they were all peacefully residing as one unit. No instance of domestic violence committed during that time has been alleged. Hence, the issue is decided against the complainant," Metropolitan Magistrate Vijeta Singh Rawat said.

The woman, a resident of Badarpur here, had sought Rs 7000 per month as maintenance and Rs five lakh compensation from her son and daughter-in-law for her sufferings and mental agony.

She had filed the plea against one of her sons and daughter-in-law alleging domestic violence by them. She also alleged that the couple also has a separate house but are forcibly retaining possession of one room and a shop at her property.

She said she required the property which was in illegal possession of the couple and further alleged that due to this dispute, they had subjected her to domestic violence by physically assaulting and abusing her.

The woman's son and daughter-in-law appeared in the court in the beginning but later stopped appearing after they were proceeded ex-parte.

In their initial reply, they said there was no domestic relation between them and the woman and also denied that she was subjected to ill treatment by them.
