Court fees row: govt questions ASG for appearing against it

Delhi government objected to the appearance of Additional Solicitor General A S Chandhiok for Delhi High Court Bar Association (DHCBA) and supporting the stand of the lawyers' body.

"First of all, the Additional Solicitor General (Chandhiok who is also President of DHCBA) should clarify this as to how he can oppose the Act passed by Delhi Assembly. Besides, this (Act) has been approved by the President of India.

"He (ASG) is also appointed by the President. It is a constitutional issue," Najmi Waziri, the counsel for the government, told a bench headed by acting Chief Justice A K Sikiri.

Chandhiok was appearing for DHCBA, which along with other bar bodies has sought directions "to hold the court fee (Delhi Amendment) Act, 2012, as void, ultra vires and unconstitutional...".

 

The court then asked Waziri to supplement his arguments with case laws and fixed the matter for hearing at 2.15 pm.

However, the bench later decided to transfer the matter to some other court.

"The bench, which hears the matter, will have to pass the order also," Justice Sikri said and ordered the matter be listed before some other bench on September 13.

Earlier, the court had stayed the government's decision to enforce the Court Fee (Delhi Amendment) Act, 2012 allowing it to effect ten-fold hike in court fees.
