A Delhi court has refused to quash criminal proceedings against a man accused of killing a woman pedestrian by rash driving, saying the plea was filed by him to drag the trial.
The court made the remark while dismissing accused Ankur Bhatnagar's revision petition against a magisterial court's order putting him on trial for offences under sections 279 (rash driving) and 304A (causing death by negligence) of IPC.
"Itappearsthatpresentrevisionpetitionhasbeenfiled onlyto wastetheprecioustimeofthecourtandtodragon trialofthecase. Hence,therevisionpetitionathandis dismissed,beingdevoidofanymerits," Additional Sessions Judge Lokesh Kumar Sharma said.
The judge also imposed a costof Rs 10,000tobe deposited withPrimeMinister'sNational Relief Fund, saying if he failed to do so, thesame shallbe recovered by the TrialCourt from him asarrearsofland revenue.
A magisterial court had on September 15, 2016 summoned Bhatnagar as accused for causing accident by rashly driving his vehicle which led to the death of a woman when she was crossing a South Delhi road.
In his appeal against the order, the accused contended that thelady metwiththe accident while crossing the road negligentlyand claimed there was no evidence against him.
