Court reinstates CISF personnel 20 yrs after dismissal

Senior Civil Judge Ajay Pandey ordered reinstatement of CISF personnel Hawa Singh, on the grounds that the findings of the departmental inquiry against him were entirely contrary to the facts and material available on record.

"The contention of the plaintiff that the inquiry findings were not based on the facts and material available on record and are rather entirely contrary to the facts and material available on record, is held to be proved," the judge said.

According to the CISF report, an intoxicated Singh had abused and misbehaved with his colleagues on February 27, 1992 night.

The inquiry official, in his report, had said Singh did not only threaten to kill a CISF head constable with his stengun but also attempted to strangulate ASI Raja Ram.

 

Singh was removed from service on August 7, 1992, while DIG CISF too upheld on December 8, 1992 his removal.

In his petition to the court against his removal, Singh had contented that the charges against him were vague, false and baseless and the inquiry against him was conducted in an unfair and illegal manner and the inquiry officer had ignored material facts and witnesses in the case. (More)
