Additional District and Sessions Judge Dig Vinay Singh restrained DDCA Joint Secretary (Accounts) Ravinder Manchanda and Ravi Jain, Joint Secretaries (Club) Subhash Sharma and Vivek Gupta, Members (executive committee) Ashok Sharma and S K Chaudhary from discharging any function as office bearers till the next date of hearing.
"The defendant no. 4 to 9 (office bearers) are restrained from discharging any function of DDCA as members of the executive committee/office bearers of the defendant no.1 pursuant to their election in the AGM held on December 21, 2012 till the next date of hearing," the court said.
The court passed the order on a suit initiated by Rajneesh Aggarwal and Vinod Garg who had contested the elections for the post of Joint Secretary (Accounts) and were aggrieved by the election process.
They had moved the court seeking declaration of the election to the above posts as null and void.
Rajneesh had told the court that according to the Articles of Association, proxy voting (if in writing and signed by the appointer) was permissible at the AGM but a large number of proxy voting was not allowed by creating commotion and he was deprived of his right to cast vote on behalf of 99 valid proxies.
