Court to hear 1984 riot victims' plea against Tytler on Oct 16

A Delhi court today decided to soon hear arguments on an anti-Sikh riot case victims' plea challenging the CBI's clean chit to Congress leader Jagdish Tytler for his alleged role in the 1984 happening.

Additional Chief Metropolitan Magistrate SPS Laler put up the matter for the next date on October 16 as the counsel for the victims was not present today.

Advocate Kamna Vohra told the court that senior advocate H S Phoolka, representing the riot victims, was busy in the Supreme Court and sought another date for advancing arguments.

The riot victims have filed a protest petition against the clean chit given thrice to Tytler by the CBI, claiming there was ample evidence to prosecute him and charging the agency with favouring him.
 

Complainant Lakhvinder Kaur, whose husband Badal Singh was killed in the riots, in her protest petition has challenged the closure report and sought the court's direction to CBI to investigate the matter further to bring on record available incriminating evidence against the accused.

Seeking to dismiss with heavy cost the protest petition filed by riot victims, CBI had said that during its probe, it has been established that Tytler "was not involved in the incident of attack which took place at Gurdwara Pulbungash on November 1, 1984".

The agency had described Tytler as "innocent" and said "it cannot falsely implicate an innocent person merely on the basis of charged sentiments and to satisfy the ego of some elements who are adamant to falsely implicate Jagdish Tytler.

"During the course of investigation and further probe, it has been established that Jagdish Tytler was not involved in the incident of attack which took place on Gurdwara Pulbangash on November 1, 1984," CBI had said in its reply filed in response to the protest petition.

It had said that no reliance can be given to arms dealer Abhishek Verma's statement recorded by CBI in which charges of influencing witness and hawala transaction had surfaced.

The victims had sought action against Tytler on allegations of influencing witness and money laundering.

CBI had earlier told the court that no fresh FIR has been lodged against Tytler on the allegations of influencing witness and money laundering.

The main case pertains to riots at Gurudwara Pulbangash in North Delhi where three people were killed on November 1, 1984 after the assassination of Prime Minister Indira Gandhi.

Tytler's alleged role in the case related to the killing of three persons, Badal Singh, Thakur Singh and Gurcharan Singh, near the gurudwara, which was re-investigated by CBI after a court had in December 2007 refused to accept closure report. Tytler has denied any role in the riots.
