Additional Sessions Judge Raj Rani Mittra upheld the order of a magisterial court, which had acquitted South East Delhi resident Nirmala Kala and her sons Rakesh Kumar and Raveti Raman, who were accused of harassing Rakesh's wife.
The sessions court acquitted the trio rejecting the prosecution's argument that the magisterial court had not appreciated the specific allegations of threatening and physically and mentally torturing the complainant.
The ASJ held that "each and every evidence of prosecution has been discussed at length and well appreciated (by the trial court). Judgement is supported by various rulings. Acquittal of respondents is on sound reasoning."
The prosecution case was that the complainant, a teacher in Delhi Administration, had married Rakesh in 1990. Soon after the marriage, the articles given to her by her parents were taken away by Rakesh, her parents-in-law Nirmala and Raj Pal Kala, a retired government servant, who passed away during the pendency of the case.
The complainant had alleged that she was beaten up, locked in a room and forced to stay without food. Nirmala was accused of threatening the complainant that she would be ablaze if she told about her harassment to anyone.
The parents of the complainant visited her matrimonial house in 1995 and that is when the matter was reported to the police. All the accused were arrested and were released on bail earlier.
