CPI(M) MLA challenges govt decision for CBI probe

CPI(M) MLA T V Rajesh today approached the Kerala High Court challenging the notification issued by the state government to handover the investigation of the murder of Abdul Shukkoor, a IUML worker, to CBI.

When the petition came up before justice Harun-Al Rashid, he posted the case to Jan 16.

Rajesh and another petitioner, Shaji KV, submitted that the government decision was with malafide intention.

Shukkoor was allegedly murdered by CPI(M) workers at Kheezhara in Kannur in February 2012. The case was originally registered by Kannapuram police station in Kannur and police filed final report.

The case is pending before Sessions Court, Thalassery.
 

According to the petitioners, the notification for CBI probe was issued by the government following pressure from a major partner in the ruling UDF.

The notification does not reveal any cogent ground for invoking the power of state under Sect 6 of Delhi Special Police Establishment Act to accord consent for investigation.
