Special CBI Judge Pradeep Chaddah fined accused J P Singh and T P Singh, the promoters of Sweska Powertech Engineering Pvt Ltd, Rs 2,000 for moving an "unnecessary application" for correction in court's order dated April 26, 2012.

Sweska Powertech was illegally benefitted in the award of street-lighting contract before the 2010 Commonwealth Games.

The accused had alleged the court, while fixing the matter for May 18, had noted in its order that the date has been given at the instance of advocates for accused even as the inspection of file revealed that the date was fixed on the request of a prosecution witness.

Claiming that the witness had written to the CBI saying he is in UAE and that the court should permit him to appear before it after May 15, the accused sought correction of the court order.

"There are six advocates appearing for different accused in this case. Whenever a date is announced, someone or the other expresses his inability to attend the court on that date. So the court tries to arrive at a consensus while giving the next date of hearing," the judge said.

"The date of May 18 had been given at the instance of the advocates (for the accused) alone," he said while refusing to make any corrections in the order.

The court dismissed their plea with a fine of Rs 2,000 on them for moving "unnecessary application".
