CWGV violation: Won't give excess FAR to pvt builder, says DDA

DDA has decided to act on the alleged violation by EMAAR MGF of the permissible Floor Area Ratio (FAR) in the construction of Commonwealth Games Village here, and said it will "retain" the "excess FAR".

The decision was taken in the key meeting of the urban body held yesterday, a DDA Member today said.

"Members during the Authority meeting were of the view that the project developer should be penalised for carrying out construction beyond the permissible limit. And, it was decided that DDA will not give any excess FAR to EMAAR," DDA Member and AAP MLA S K Bagga said.
 

"The excess FAR of 12,841 sq m is not compoundable and therefore we will retain that," he said, adding, "if any DDA official is also found involved in this, action will taken against that person too".

EMAAR MGF when contacted, said, "We are not aware of any such development."

Denying the allegation, an official spokesperson of the realty major said, "We can tell you that the construction of CWGV project is strictly in accordance with the permitted building bye-laws, master plan and zonal development plan."

The official said the discrepancy has come up since DDA is taking reference point of the "older sanction plan, while we (EMAAR) go by the Master Plan of Delhi (MPD) 2021."

"And, according to the MPD 2021, the actual FAR constructed is less than the FAR permissible," he claimed.

The Village project was implemented by DDA for the 2010 Commonwealth Games in a PPP mode with Emaar MGF Construction Ltd, and the company built 1,168 flats under it, he said.

A senior DDA official said, "the matter came up since the company had crossed the permissible FAR limit. The matter then went to the court, which sent it to the Urban Development Ministry. The ministry then asked the Authority to decide on it."

"We have still not received any communication in this regard and we will respond accordingly when we receive the same," the company's senior official said.
