Dairy owner acquitted of charges of selling adulterated curd

Additional Chief Metropolitan Magistrate Mohinder Virat acquitted dairy owner-cum-shopkeeper Puran Mal Gupta of the charges under the Prevention of Food Adulteration Act.

The court acquitted him on the ground that the samples of the curd of toned milk, taken from Puran's shop were sent for analysis to two different laboratories, which gave "totally contradictory" findings after them.

"Perusal of the report of public analysts makes it clear that the given sample counterpart had been adjudged deficient in respect of 'milk solids not fat.' However, the second counterpart of the same sample when analysed there in CFL, Pune, was found deficient in respect of 'milk fat.'

 

"Both the reports are totally contradictory to each other. The accused deserved to be given the benefit thereof. Accordingly, he is hereby acquitted of the charges, levelled against him," the court said.

According to Food Inspector Mukesh Kumar Gupta, he had taken a sample of 600 gms curd made from toned milk in June 2009 for analysis from Puran's dairy in Paharganj area here.

He said the sample was divided into three parts, which were analysed by the public analysts here and the Central Forensic Laboratory (CFL), Pune.
