The probe agency and Dara's wife filed the petitions against the order passed by Jaipur District and Sessions Judge P C Jain, arguing that Rathore cannot be discharged at an initial stage of the trial without going through the evidence and hearing the case of prosecution.
Rathore was discharged from being the main conspirator in the alleged staged encounter of the liquor mafia by a local court on May 31, following which he was released from Jaipur Central Jail.
The MLA is allegedly the mastermind of the fake encounter as he was having rivalry with the deceased for supporting one group of liquor mafia of Rajasthan's Jhunjhunu district.
The case is likely to be taken up in first week of July.
