Delhi-Gurgaon expressway: Status quo till Sep 28

A Division Bench headed by Chief Justice Arjan Kumar Sikri today referred the case to another Bench.

The case is expected to come up for hearing before the Special Bench of Justice Jasbir Singh, which has been hearing the matter till the previous hearing on September 20- the day after which Justice Sikri took over as the High Court's Chief Justice.

Last week, the High Court had extended the ban on collection of toll from private vehicles plying on the expressway till today.

The September 4 directions restraining the concessionaire from collecting the toll came after the Gurgaon traffic police had moved the High Court alleging that the concessionaires were responsible for the traffic snarls at expressway as they lacked required staff to deal with the problem.

 

However, the court, on the previous hearing had ordered that all commercial vehicles will pay the toll with effect from 6 PM of that day and they will continue to do so and there is no change in that status.

On the previous hearing, the division bench comprising Justice Jasbir Singh, who was then Acting Chief Justice and Justice R K Jain, had appointed former Chief Justice of the High Court Mukul Mudgal as local commissioner to inspect the area and submit its report by Monday.

Justice Mudgal had to report by Monday to the High Court as to whether the concessionaire--Delhi Gurgaon Super Connectivity Limited (DGSCL)--has implemented the decongestion plan submitted by it.

However, as the case was adjourned, the report submitted by Justice Mukul Mudgal yesterday could not come up for consideration.

The court had earlier directed the concessionaires to implement the provisions submitted by it to decongest the Expressway that included increasing the number of toll lanes from 32 to 53.

Justice Mudgal has recommended that widening of the road from Udyog Vihar must be accorded priority.

He has also recommended that the hand held devices should be substituted with handy apparatus, which could be integrated to the server already recording the number of vehicles passing through the area.MORE
