Delhi Police cop injured in road accident gets over Rs 5L

A Delhi police constable, who was injured in a motorcycle crash last January, has been awarded a compensation of over Rs 5 lakh by a Motor Accident Claims Tribunal (MACT) here.

MACT Presiding Officer Madhu Jain directed the Shriram General Insurance Company Limited, to pay Rs 5.17 lakh to the Uttar Pradesh resident and policeman, Indraj Singh.

"Petitioner (Singh), for purpose of present proceedings, has been able to prove that he suffered injuries due to rash and negligent driving of the Respondent 1 (driver Gajender Singh)," the court said.

"The petitioner/injured (Indraj Singh) is hereby awarded a sum of Rs 5,17,000," it said while directing the insurance firm to pay the compensation amount.
 

According to the petitioner, on January 6, 2014, Indraj was riding his motorcycle towards Noida when the bike driven by Gajender in a rash and negligent manner, hit him.

Due to the impact, Indraj suffered injuries and was taken to a hospital.

The insurance company in its reply before the tribunal claimed that as the accident took place due to carelessness and negligence of the petitioner, therefore driver, owner and insurance company of the offending motorcycle were not liable to pay compensation.

"No presumption against the petitioner can be raised merely for the reason that since he is a constable in Delhi Police, therefore, he manipulated his own accident and falsely implicated the offending vehicle," the court also said as it dismissed the insurance firm's contention.

The company had also contended that the injured, being a constable himself, had influence and authority to involve any person for compensation which amounted to abuse of his own position.
