A court here today fixed February 20 for seeking clarification from Delhi Police on whether any fresh evidence has emerged against top LeT bomb expert Abdul Karim Tunda who has been chargesheeted in a case lodged in 1994 in connection with recovery of explosive substances.

Additional Sessions Judge Bharat Parashar, who was scheduled to hear the matter today, fixed it for February 20 as the prosecutor was unavailable to advance the submissions.

The court had earlier told the special cell of Delhi Police that if there was no new evidence against Tunda, then it will be a "futile exercise" to proceed with the case.

The court had also said that in the case, in which a supplementary charge sheet was recently filed against Tunda, some of the accused arrested earlier have already been acquitted by the trial court.

"If the evidence is the same and the judgement has attained finality, I cannot do anything...Why should we go on a futile exercise"? the judge had said.

The court had asked the police whether the grounds, on which accused were acquitted earlier, have been covered in the supplementary charge sheet filed against Tunda.
