Dewani loses latest battle against extradition to South Africa

An Indian-origin British businessman, accused of organising the murder of his Indo-Swedish wife on their honeymoon in South Africa, has lost his latest appeal to block his extradition.

Shrien Dewani, 33, is fighting a return to South Africa to face the charges, which he denies, over the death of his wife Anni Dewani in November 2010.

His legal team had wanted to challenge an earlier High Court ruling that he could be extradited.

However, a panel of judges refused to allow the case to be heard in the Supreme Court.

Dewani, from Bristol, is being compulsorily detained under the Mental Health Act, suffering from severe depression and post-traumatic stress disorder.
 

His lawyer told Lord Chief Justice Lord Thomas and two other judges at the High Court in London that his "underlying medical condition" may have become chronic, making it "untreatable".

In January, the High Court ruled it would not be "unjust and oppressive" to extradite Dewani if assurances were received from South Africa about the length of time he would be kept in the country without trial.

The South African authorities have given the necessary assurances, but Dewani's lawyers returned to London's high court to challenge the undertaking.

But the judges rejected complaints made about the adequacy of the undertaking.

Dewani is suspected of ordering the killing of his wife, a 28-year-old Swedish national.

The pair were held at gunpoint while driving through Cape Town in a taxi.

Dewani was released unharmed but his wife's body was found in the car with injuries to her head and chest the following day.

Prosecutors allege South African national Xolile Mngeni, who was later convicted of premeditated murder and jailed for life, had been hired by Dewani to kill his wife.

The legal battle to keep Dewani in England until he is well enough to travel has been ongoing since 2011.
